Terms and Conditions

1. رخصة القيادة / Driving License

يجب أن يكون المستأجر والسائق الإضافي المصرح له حاملاً لرخصة قيادة سارية المفعول ومعترف بها من إدارة المرور في دولة الإمارات العربية المتحدة، وأن يلتزم بكافة 

قوانين وأنظمة السير، ويتحمل المسؤولية الكاملة عن المركبة خلال فترة الإيجار.

 

Renter and authorized additional driver must hold a valid driving license recognized by UAE Traffic Department, comply with all traffic laws and regulations, and bear full responsibility for the vehicle during rental period.

 

2. المخالفات المرورية / Traffic Fines

 يتحمل المستأجر كافة المخالفات المرورية ورسوم الحجز والمخالفات الأخرى من تاريخ بداية العقد حتى تاريخ الإعادة الفعلية للمركبة، بالإضافة إلى 25 درهم رسوم إدارية عن كل مخالفة، ويجوز خصمها من مبلغ الضمان.

 

Renter bears all traffic fines, impound fees and other violations from contract start date until actual return date, plus AED 25 admin fee per violation, may be deducted from security deposit.

 

3. الإيجار / Rent

 يلتزم المستأجر بسداد قيمة الإيجار مقدماً قبل استلام المركبة.

 

Renter shall pay rental value in advance before receiving vehicle.

 

4.التمديد واتساب فقط / Extension WhatsApp Only

 يلتزم المستأجر بإعادة المركبة فور انتهاء المدة المتفق عليها. التمديد حصرياً عن طريق الواتساب فقط: 

أ) يرسل المكتب رابط التمديد الرسمي عبر الواتساب، يختار العميل المدة ويدفع مباشرة عبر الرابط، ويعتبر الدفع عبر الرابط موافقة صريحة وتمديداً رسمياً تلقائياً بنفس شروط العقد والتأمين دون الحاجة لعقد جديد. 

ب) في حال عدم استخدام الرابط، يجب إرسال طلب التمديد عبر الواتساب فقط للرقم الرسمي للمكتب والحصول على موافقة خطية عبر الواتساب قبل انتهاء العقد بـ 24 ساعة على الأقل، وإبرام عقد جديد. يمنع منعاً باتاً الاستمرار باستخدام المركبة بعد انتهاء العقد بدون موافقة خطية عبر الواتساب.

 

Renter must return vehicle immediately upon expiry of agreed period. Extension exclusively via WhatsApp only: 

A) Office sends official extension link via WhatsApp, client selects duration and pays directly via link, payment via link constitutes explicit consent and automatic official extension under same contract terms and insurance without need for new contract. 

B) If link not used, extension request must be sent via WhatsApp only to official Office number and obtain written approval via WhatsApp at least 24 hours before contract expiry, and conclude new contract. Continuing to use vehicle after contract expiry without written WhatsApp approval is strictly prohibited.

 

5. الاستخدام / Usage

 يمنع رهن المركبة أو بيعها أو تأجيرها من الباطن أو استخدامها في أغراض تجارية أو غير مشروعة. الاستخدام شخصي فقط للمستأجر المصرح له.

 

Pledging, selling, subleasing the vehicle or using it for commercial or illegal purposes is prohibited. Personal use only for authorized Renter.

 

6. التعديل / Modification

 يمنع إضافة أو إزالة أو تعديل أي جزء أو ملحق أو جهاز من المركبة، ويجب إعادتها بنفس الحالة التي استلمها بها.

 

Adding, removing or modifying any part, accessory or device of vehicle prohibited, must return in same condition as received.

 

7. الأعمال غير القانونية / Illegal Use

 يتحمل المستأجر كامل المسؤولية القانونية والمالية والقيمة الكاملة للمركبة في حال مصادرتها أو حجزها بسبب استخدامها في أعمال غير قانونية أو القيادة تحت تأثير الكحول أو المخدرات أو أي مواد محظورة.

 

Renter bears full legal and financial liability and full value of vehicle if confiscated or impounded due to use in illegal acts or driving under influence of alcohol, drugs or any prohibited substances.

 

8. حدود الدولة / Borders

 يمنع إخراج المركبة خارج حدود دولة الإمارات العربية المتحدة تحت أي ظرف.

 

Taking vehicle outside UAE borders under any circumstance is prohibited.

 

9. مدة العقد / Contract Period

 يسري العقد من تاريخ التوقيع عليه وينتهي بانتهاء مدته المحددة، ويمكن تمديده حصرياً عبر الواتساب حسب البند 4.

 

The contract is effective from signing date and ends upon expiry of its specified duration, can be extended exclusively via WhatsApp per clause 4.

 

10. الحالة الفنية / Technical Condition

يلتزم المكتب بتسليم المركبة بحالة فنية سليمة وصالحة للسير. على المستأجر مراقبة لوحة القيادة والإبلاغ الفوري عبر الواتساب عند ظهور أي تحذير أو عطل، ويمنع فتح غطاء المحرك أو محاولة الإصلاح.

 

 Office commits to deliver vehicle in sound technical condition and roadworthy. Renter must monitor dashboard and immediately notify via WhatsApp upon any warning or malfunction, opening engine hood or attempting repair prohibited.

 

11. الفسخ / Termination

 يحق للمكتب فسخ العقد فوراً واسترداد المركبة في حال عدم سداد الإيجار أو المخالفات أو مخالفة أي من شروط العقد.

 

Office entitled to terminate contract immediately and recover vehicle in case of non-payment of rent or fines or violation of any contract terms.

 

12. التسليم للغير / Handover to Others

لا يحق للمستأجر تسليم المركبة أو السماح بقيادتها لأي شخص غير مصرح له ومذكور اسمه في العقد.

 

 Renter not entitled to hand over vehicle or allow driving by any unauthorized person not named in contract.

 

13. التأمين / Insurance

 المركبة مؤمنة تأمين شامل حسب شروط وأحكام وثيقة التأمين السارية لدى شركة التأمين. في الحوادث التي يكون فيها المستأجر هو المتسبب حسب تقرير الشرطة الرسمي، يتحمل المستأجر 1500 درهم رسوم فتح ملف الحادث + 20% من قيمة الإصلاح الفعلية حسب فاتورة الوكالة طبقاً لشروط وثيقة التأمين، بالإضافة إلى بدل توقف المركبة عن العمل بقيمة الإيجار اليومي لمدة الإصلاح بحد أقصى 10 أيام.

 

Vehicle comprehensively insured per terms and conditions of valid insurance policy with insurance company. In accidents where Renter is at fault per official police report, Renter bears AED 1500 accident file opening fee + 20% of actual repair value per agency invoice per insurance policy terms, plus loss of use at daily rental rate for repair duration max 10 days.

 

14.  الحوادث وضد مجهول وكسر الزجاج / Accidents & Against Unknown & Glass 

 يمنع مغادرة موقع الحادث حتى وصول الشرطة والحصول على تقرير شرطة أصلي. يجب إبلاغ المكتب خلال 24 ساعة عبر الواتساب والحصول على موافقة خطية قبل أي إصلاح. 

أ) المتسبب حسب تقرير الشرطة الرسمي: يتحمل المستأجر 1500 درهم رسوم فتح ملف + 20% من قيمة الإصلاح حسب فاتورة الوكالة طبقاً لشروط وثيقة التأمين + بدل توقف بقيمة الإيجار اليومي لمدة الإصلاح بحد أقصى 10 أيام. 

ب) تقرير ضد مجهول: يعامل معاملة المتسبب تماماً بنفس الشروط المذكورة في الفقرة (أ) أعلاه، ويتحمل المستأجر نفس التكاليف والرسوم كاملة. 

ج) كسر زجاج السيارة أو تلف/دعم الإطار: في حال كان ناتجاً عن إهمال المستأجر أو سوء استخدام أو كان بتقرير حادث ضد مجهول، يتحمل المستأجر كامل التكلفة الفعلية للإصلاح أو الاستبدال حسب فاتورة الوكالة، ولا يشمله التأمين، بالإضافة إلى بدل توقف حسب مدة الإصلاح.

 

Leaving accident site prohibited until police arrival and obtaining original police report. Office must be notified within 24 hours via WhatsApp and obtain written approval before any repair. 

A) At-fault per official police report: Renter bears AED 1500 file opening fee + 20% of repair value per agency invoice per insurance policy terms + loss of use at daily rental rate for repair duration max 10 days. 

B) Against unknown report: Treated exactly as at-fault with same conditions mentioned in paragraph (A) above, Renter bears same costs and fees in full. 

C) Car glass breakage or tire/rim damage: If resulting from Renter negligence or misuse or with against unknown accident report, Renter bears full actual cost of repair or replacement per agency invoice, not covered by insurance, plus loss of use per repair duration.

 

15.التدخين والحيوانات / Smoking & Pets 

 يمنع التدخين داخل المركبة منعاً باتاً بكافة أنواعه (سجائر، شيشة، فيب)، ويمنع دخول الحيوانات بكافة أنواعها. في حال مخالفة ذلك يتحمل المستأجر غرامة تنظيف وتعقيم شامل لا تقل عن 500 درهم، ويحق للشركة تقدير المبلغ النهائي حسب حجم الضرر ودرجة التلوث والروائح، ويجوز خصم المبلغ من مبلغ الضمان أو المطالبة به بشكل منفصل، بالإضافة إلى تكلفة الغسيل المتخصص وإزالة الروائح إن لزم الأمر.

 

 Smoking inside vehicle strictly prohibited in all forms (cigarettes, shisha, vape), and entry of animals of all kinds prohibited. In case of violation, Renter bears comprehensive cleaning and sterilization fine not less than AED 500, Company entitled to estimate final amount per damage extent and pollution and odors degree, may be deducted from security deposit or claimed separately, plus specialized washing and odor removal cost if required.

 

16. النظافة / Cleanliness 

يلتزم المستأجر بإعادة المركبة نظيفة من الداخل والخارج بنفس حالة التسليم التي استلمها بها. في حال إعادتها متسخة، يتحمل المستأجر رسوم تنظيف لا تقل عن 250 درهم، ويحق للشركة تقدير المبلغ النهائي حسب حالة الاتساخ ودرجته، ويجوز خصم المبلغ من مبلغ الضمان، وإذا تجاوزت تكلفة التنظيف المتخصص المبلغ المذكور يتحمل المستأجر الفارق كاملاً.

 

Renter commits to return vehicle clean inside and outside in same delivery condition as received. If returned dirty, Renter bears cleaning fee not less than AED 250, Company entitled to estimate final amount per dirtiness condition and degree, may be deducted from security deposit, and if specialized cleaning cost exceeds mentioned amount Renter bears full difference.

 

17. الإعادة المبكرة / Early Return

 مدة العقد الشهري 30 يوم. في حال إعادة المركبة قبل انتهاء المدة المتفق عليها، يتم احتساب الإيجار على أساس السعر اليومي حسب تسعيرة الشركة الرسمية للسعر اليومي وطول الفترة المستخدمة فعلياً، أو دفع قيمة الشهر كامل، حسب ما تراه الشركة ويحقق مصلحتها، ويجوز خصم الفارق من مبلغ الضمان.

 

Monthly contract duration 30 days. In case of returning vehicle before expiry of agreed period, rent shall be calculated on daily rate basis per Company's official daily rate pricing and actual duration used, or payment of full month value, as deemed appropriate by Company in its best interest, difference may be deducted from security deposit.

 

18.حد المسافة / Mileage 

 الحد الأقصى للمسافة المسموح بها: اليومي 350 كم فقط. أكثر من يوم واحد يكون حد المسافة حسب الاتفاق المسبق عبر الواتساب فقط وبموافقة خطية من المكتب. الحد الشهري 5000 كم. في حال تجاوز الحد المسموح، تحتسب الكيلومترات الزائدة على النحو التالي: السيارات الصغيرة والسيدان 1 درهم لكل كيلومتر زائد، سيارات الدفع الرباعي SUV والفاخرة 3 دراهم لكل كيلومتر زائد، ويجوز خصمها من مبلغ الضمان أو المطالبة بها بشكل منفصل.

تعتمد قراءة عداد المسافات و GPS الرسمي للمركبة كمرجع أساسي وحاسم لحساب المسافة.

 

Maximum mileage allowance: Daily 350 km only. More than one day, mileage limit as per prior agreement via WhatsApp only with written approval from Office. Monthly limit 5000 km. In case of exceeding allowed limit, extra kilometers charged as: Small/Sedan AED 1 per extra km, SUV/Luxury AED 3 per extra km, may be deducted from security deposit or claimed separately. Odometer reading and official vehicle GPS shall be primary and conclusive reference for mileage calculation.

 

19. العطل الرسمية / Official Holidays

 يمنع إرجاع السيارة في أيام العطل الرسمية بدون حجز موعد مسبق عبر الواتساب وموافقة خطية.

 

Returning vehicle on official holidays prohibited without prior appointment via WhatsApp and written approval.

 

20. المسؤولية التضامنية / Joint Liability

 المستأجر والسائق الإضافي المصرح له مسؤولان بالتضامن عن كافة الالتزامات والرسوم الناتجة عن هذا العقد.

 

 Renter and authorized additional driver jointly liable for all obligations and fees resulting from this contract.

 

21. التنازل عن البلاغ / Waiver of Report

 عند طلب المستأجر التنازل عن بلاغ أو إغلاق ملف مروري، يتحمل المستأجر 500 درهم رسوم إدارية للمكتب بالإضافة إلى الرسوم الحكومية المقررة.

 

Upon Renter requesting waiver of report or closing traffic file, Renter bears AED 500 admin fees for Office plus prescribed governmental fees.

 

22. رسوم المرور / Toll Fees 

: جميع رسوم المرور على عاتق المستأجر بالكامل دون استثناء وتشمل 

أ) القيمة الأساسية الفعلية المخصومة من حساب الشركة لدى الجهة الحكومية وقت العبور الفعلي. 

ب) سالك دبي: حسب التعرفة الرسمية المتغيرة وقت العبور وهي 5 أو 6 أو 8 دراهم غير شاملة ضريبة القيمة المضافة حسب وقت الذروة. 

ج) درب أبوظبي: حسب التعرفة الرسمية المطبقة وقت العبور. 

د) ويضاف إلى القيمة الأساسية رسوم إدارية وتشغيلية مقابل متابعة وتسديد وإدارة حسابات المرور وتوفير خدمة محفظة سالك ودرب وإدارتها على مدار الساعة، ويجوز خصمها من مبلغ الضمان.

 

All toll fees shall be borne entirely by Renter without exception including: 

A) Base actual amount deducted from Company account with governmental entity at actual crossing time.

B) Salik Dubai: per official variable tariff at crossing time which is AED 5 or 6 or 8 excluding VAT per peak time. 

C) Darb Abu Dhabi: per official applicable tariff at crossing time. 

D) Plus administrative and operational fees for following, payment and management of traffic accounts and providing and managing Salik and Darb wallet service around the clock, may be deducted from security deposit.

 

23. رسوم المواقف / Parking Fees 

 جميع رسوم المواقف على عاتق المستأجر بالكامل دون استثناء، وتشمل : 

أ) القيمة الأساسية الفعلية المخصومة من حساب الشركة لدى الجهة الحكومية أو الخاصة وقت الوقوف الفعلي. 

ب) المواقف الحكومية: مواقف درب أبوظبي و RTA دبي. 

ج) المواقف الخاصة والذكية المرتبطة بنظام سالك مع Parkonic مثل شمس بوتيك و WTC و Nation Towers و ياس باي وغيرها، والتي تخصم تلقائياً من محفظة سالك الخاصة بالمركبة. 

د) ويضاف إلى القيمة الأساسية رسوم إدارية وتشغيلية مقابل متابعة وتسديد وإدارة حسابات المواقف وخدمة المحفظة على مدار الساعة 24/7، ويجوز خصمها من مبلغ الضمان أو المطالبة بها بشكل منفصل.

هـ) تخلي الشركة مسؤوليتها بالكامل عن المواقف الطابقية والمواقف الخاصة غير المرتبطة بالنظام والمواقف الذكية التي تتطلب دفع مباشر من المستأجر في الموقع.

 

All parking fees shall be borne entirely by Renter without exception, including: 

A) Base actual amount deducted from Company account with governmental or private entity at actual parking time. 

B) Government parking: Darb Abu Dhabi and RTA Dubai parking. 

C) Private and smart parking linked to Salik system with Parkonic such as Shams Boutik, WTC, Nation Towers, Yas Bay and others, auto deducted from vehicle's Salik wallet. 

D) Plus administrative and operational fees for following, payment and management of parking accounts and wallet service 24/7, may be deducted from security deposit or claimed separately. E) Company disclaims all responsibility for multi-storey parking and private parking not linked to system and smart parking requiring direct payment by Renter on site.

 

24. روابط الدفع / Payment Links

 عند إرسال رابط دفع إلكتروني عبر الواتساب للمواقف أو المخالفات أو الرسوم، يجب على المستأجر الدفع فوراً والاحتفاظ بالإيصال وإرسال صورة منه عبر الواتساب.

 

 When electronic payment link sent via WhatsApp for parking or fines or fees, Renter must pay immediately and keep receipt and send copy via WhatsApp.

 

25.الموافقة على الواتساب / WhatsApp Consent

 أوافق بموافقتي الصريحة والكاملة على استلام جميع الإشعارات والمراسلات المتعلقة بهذا العقد، بما في ذلك الفواتير والإيصالات وروابط الدفع والتذكير والتنبيهات وصور وفيديوهات حالة المركبة قبل وبعد، عبر الواتساب على الرقم المسجل باسمي في العقد، وتعتبر هذه المراسلات رسمية وملزمة قانوناً ويعتبر استلامها تبليغاً رسمياً، وأوافق على احتساب القيمة الأساسية للخدمات الحكومية مضافاً إليها رسوم الخدمة الإدارية والتشغيلية المذكورة في البندين 22 و 23.

 

I explicitly and fully consent to receive all notifications and correspondence related to this contract, including invoices, receipts, payment links, reminders, alerts and photos/videos of vehicle condition before and after, via WhatsApp on number registered in my name in contract, these correspondences considered official and legally binding and receipt considered official notification, and I agree to calculation of base value of governmental services plus administrative and operational service fees mentioned in clauses 22 and 23.

 

26. الوقود / Fuel

 يلتزم المستأجر بإعادة المركبة بنفس مستوى الوقود عند الاستلام، وإلا يتحمل 100 درهم رسوم خدمة تعبئة بالإضافة إلى ثمن الوقود.

 

Renter commits to return vehicle with same fuel level as at receipt, otherwise bears AED 100 refueling service fee plus fuel cost.

 

27. المفتاح والملحقات / Key & Accessories

 في حال فقدان المفتاح أو الريموت يتحمل المستأجر 800 إلى 1500 درهم حسب نوع المركبة، وفقدان المثلث التحذيري وطفاية الحريق 150 درهم.

 

In case of loss of key or remote Renter bears AED 800 to 1500 per vehicle type, loss of warning triangle and fire extinguisher AED 150.

 

28. الإطارات والرنجات والاندر بودي / Tyres, Rims & Underbody 

 تلف أو ضرر الإطارات والرنجات (الجنوط) والاندر بودي (أسفل المركبة وهيكلها السفلي) لا يشمله التأمين الشامل نهائياً تحت أي ظرف، سواء كان ناتجاً عن إهمال أو سوء استخدام أو اصطدام برصيف أو حفرة أو مطب أو حادث مروري. وفي جميع الأحوال يتحمل المستأجر كامل التكلفة الفعلية للإصلاح أو الاستبدال حسب فاتورة الوكالة الرسمية أو المورد المعتمد، بالإضافة إلى بدل توقف المركبة عن العمل بقيمة الإيجار اليومي حسب مدة الإصلاح أو توفير القطعة، ولا يحق له المطالبة بالتأمين.

 

Damage to tires, rims (wheels) and underbody (vehicle underside and lower chassis) is never covered by comprehensive insurance under any circumstance, whether resulting from negligence, misuse, hitting curb, pothole, speed bump or traffic accident. In all cases Renter shall bear full actual cost of repair or replacement per official agency invoice or approved supplier, plus loss of use at daily rental rate for duration of repair or part availability, and shall have no right to claim insurance.

 

29. التأخير / Delay

 يمنح المستأجر مهلة سماح 30 دقيقة عند الإعادة، بعدها يحتسب يوم إيجاري كامل عند التأخير أكثر من 3 ساعات بدون إبلاغ مسبق عبر الواتساب يعتبر سوء نية ويحق للمكتب اتخاذ الإجراءات القانونية.

 

Renter granted 30 minutes grace period upon return, after that full rental day charged If the Delay more than 3 hours without prior notification via WhatsApp considered bad faith and Office entitled to take legal actions.

 

30. العبث / Tampering

يمنع العبث بعداد المسافات أو جهاز التتبع GPS أو أي جهاز بالمركبة - غرامة 2000 درهم بالإضافة إلى المسؤولية القانونية والتعويض عن أي ضرر.

 

Tampering with odometer or GPS tracking device or any device in vehicle prohibited - AED 2000 fine plus legal liability and compensation for any damage.

 

31. الصور والفيديوهات / Photos & Videos

الصور والفيديوهات المرسلة عبر الواتساب لحالة المركبة قبل وبعد تعتبر جزء لا يتجزأ من هذا العقد ودليل إثبات ملزم، وعدم اعتراض المستأجر عليها خلال 10 دقائق من الإرسال يعتبر موافقة نهائية عليها.

 

Photos and videos sent via WhatsApp of vehicle condition before and after considered integral part of this contract and binding evidence, Renter's failure to object within 10 minutes from sending considered final approval.

 

32. المستندات / Documents

يلتزم المستأجر بالاحتفاظ بنسخة من هذا العقد ورخصة المركبة (الملكية) داخل المركبة طوال فترة الإيجار وإبرازها عند الطلب.

 

 Renter must keep copy of this contract and vehicle license (registration) inside vehicle throughout rental period and present upon request.

 

33. المقيم / Resident

للمقيمين: مبلغ الضمان 1000 إلى 2000 درهم حسب نوع المركبة + صورة الهوية الإماراتية + رخصة قيادة إماراتية سارية. يرد مبلغ الضمان بعد 15 يوم من إعادة المركبة بعد التأكد من عدم وجود مخالفات أو رسوم مستحقة.

 

 For Residents: security deposit AED 1000 to 2000 per vehicle type + Emirates ID copy + valid UAE driving license. Deposit refunded after 15 days from vehicle return after ensuring no fines or due fees.

 

34. الزوار والسياح / Visitors & Tourists 

 للزوار والسياح: يتم دفع مبلغ تأمين 2000 درهم. طرق الدفع: نقداً أو بطاقة ائتمان. المستندات المطلوبة: جواز سفر + تأشيرة زيارة سارية + رخصة قيادة سارية ومعترف بها ومقبولة لدى وزارة الداخلية في دولة الإمارات، وتشمل: رخصة قيادة دولية سارية، أو رخصة قيادة صادرة من الدول المعتمدة والمقبولة لدى وزارة الداخلية مثل الولايات المتحدة الأمريكية، المملكة المتحدة، كندا، أستراليا، دول الاتحاد الأوروبي، دول مجلس التعاون الخليجي، وغيرها من الدول المعتمدة حسب قائمة وزارة الداخلية المحدثة. استرجاع مبلغ الضمان: بعد 15 يوم من إرجاع السيارة، بعد خصم المخالفات والرسوم المستحقة إن وجدت.

 

For Visitors & Tourists: security deposit AED 2000 paid. Payment methods: cash or credit card. Required documents: passport + valid visit visa + valid driving license recognized and accepted by Ministry of Interior in UAE, including: valid international driving license, or driving license issued by countries approved and accepted by Ministry of Interior such as USA, UK, Canada, Australia, EU countries, GCC countries, and other approved countries per updated Ministry of Interior list. Deposit refund: after 15 days from returning car, after deducting fines and due fees if any.

 

35. الأغراض الشخصية / Personal Belongings

 المكتب غير مسؤول عن أي أغراض شخصية أو مقتنيات تترك داخل المركبة بعد إعادتها.

 

Office not responsible for any personal belongings or items left inside vehicle after return.
